MLS® Requirements for Data Licensing when signing up with Repliers
Overview
Repliers requires access to MLS data. Repliers is not permitted to authorize access to MLS data without the consent of the MLS. There are two paths to receiving MLS authorization:
Path 1 - MLS Participant
Agents, teams, and brokerages with an active MLS membership can subscribe to Repliers. An MLS participant may share access to Repliers with a technical consultant at their own risk. The MLS participant is responsible to ensure that Repliers is used in accordance with its terms of service.
The MLS participant's access to Repliers is intended for their sole use and may not be used to build a product or service that's not apparently operated by the MLS participant.
A few important constraints:
- Most of the time the MLS® data license will require the brokerage approval. The broker of record must sign the data agreement.
- A single license covers only the markets that license was issued for. Accessing data from a different region requires a separate license for that region.
- The license covers the MLS participant's own business use only. It cannot be used to build tools for other agents, share access with business partners, or power a separate commercial product.
- A Repliers subscription is limited in scope to a single use case. Repliers will assist the MLS participant through the data licensing process with the MLS.

Path 2 - Technology Vendor Building for MLS Participants
Technology companies can subscribe to Repliers where Repliers operates in a subcontractor capacity. Technology companies are responsible for procuring their own MLS data licenses and for managing licensing and compliance with their subscribers.
In this framework, Repliers operates strictly as a technology layer and does not manage licensing relationships on behalf of the vendor's clients.
Vendor access works differently from member access:
- A vendor license must be obtained independently from each MLS whose data the vendor's product will use. Repliers does not assist vendors with data license applications.
- Most MLSs require an existing member to endorse the vendor application. That member must intend to use the product the vendor is applying to build.
- Once approved, the vendor must deploy solutions that are under the apparent control of a participating member. The vendor is not permitted to use their data access to launch a product for themselves. The vendor must disclose each participating member to the MLSs that is using its product. Reporting requirements vary from MLS to MLS. The license does not permit operating consumer-facing platforms under the vendor's own brand or building tools for non-member clients such as mortgage brokers.
- The vendor must hold an active Repliers subscription for each MLS they are approved to access and intend to use with Repliers. Each MLS is a separate subscription.

Licensed Scope Is Fixed at Approval
Regardless of path, an MLS data license is granted for a specific scope approved during the application process. That scope defines what the data can be used for, in what context, and for which audience. Expanding or changing that scope, including using the data for additional purposes not covered by the original agreement, is prohibited. A new application and data license agreement is required for any scope change.

Repliers can provide guidance on licensing based on experience working with MLSs across various use cases. However, every use case is unique and the final decision on eligibility, scope, and approval rests solely with the MLS. Any guidance from Repliers should be treated as informational and not as a substitute for direct confirmation from the relevant MLS.
